" The Amnesty international " - exposes the facts of torture in Ukraine... Or While at new authority of a hand do not reach.

May 11, 2005.

*** the AmnestyInternational has addressed with the missive to Minister of Justice of Ukraine Romana Zvarich in occasion of two serious cases of torture and the inhuman reference, registered in Ukraine.

The secretary general of International Amnesty Airan Caen on May, 4th has directed the missive to Roman Zvarich in which has paid attention of Minister and has stated concern concerning cases of torture. In particular in the letter it is a question of two cases in which the organization is engaged.

The first case concerns six person among which one child (18 monthly age), which have been detained in Simferopol (AR Crimea) in connection with investigation of a crime (in particular it is Gennady Vladimirov, Valery Vladimirov, Jury Barsjuk, Tatyana and Oleg Doroshenko, Tatyana Vorobyova).

The international Amnesty concerned by that all these persons were, as inform, citizens to torture and the inhuman reference for the sake of reception of certificates or a recognition in fulfilment of a crime. It is rough infringement of the international obligations of Ukraine, in particular Conventions of the United Nations against tortures, and also the European Convention of protection of human rights and basic freedom.

Secondly, victims of tortures had no duly access to lawyers and had an opportunity to communicate to the lawyer only after clearing which also is rough infringement of certain clauses of the Criminal code of Ukraine.

Thirdly, the International Amnesty is seriously concerned by the fact the reference with Oleg Doroshenko (to which for the period of detention was only 18 months) whom used for pressure upon his mother that is inadmissible. The convention of the United Nations on the rights of the child implicitly defines, that the child I can not be separated from the parents, except for those cases when such isolation serves interests of the child, and also, that the child can be concluded only as a last resort.

Despite of complaints of persons which became victims of the inhuman reference, the International Amnesty does not have any information that there was lead any investigation of this case for revealing circumstances of affairs and punishment guilty in raised human rights.

The second case touches Michael Kuznetsa, his wife Anna Kuznets and their son - Dmitry Brick (Kuznets). As it is informed, they have tested the inhuman reference and torture from workers of law enforcement bodies Chernigov city to a site of militia in August, 2001. In this case the International Amnesty is concerned by that workers of militia have applied torture in relation to Michael Kuznetsu and Dmitry Brick with the criminal purpose: to force men to transfer "voluntary" in militia the property not as the proof, and for the sake of own benefit.

The international Amnesty is disturbed by obvious impunity of militias personel which appear in this case.

In the letter it is emphasized, that cases of torture in Ukraine are not single, they brightly illustrate the some people owing to what torture and the inhuman reference till now are widely applied in places of the previous conclusion.

The international Amnesty has stated some recommendations which will help Ukraine to change a situation and completely to carry out of the obligations which the country has as the participant of the international contracts and agreements from human rights.
