Now, the candidate loser Yanukovich is about to lodge a complaint to the Supreme Court in the aim to revoke the results of the revote 2nd round of December 26.

January 16, 2005.

    ***
In other words, it he makes efforts to cancel the victory of Yuschenko, even if was beaten with the margin at up to 8 %.

Yanukovich does not recognize this margin. And in spite of 12 millions votes obtained instead of 15 millions, his result during the previous vote, he guesses the results of December 26 do confirm his victory of November 21. He has explained such a loss of 3 million votes, saying that his voters could not vote, due to this new electoral law adopted by the Parliament that limited the voting at home. However, he would use as grounds for his complaint this problem. And if the CEC had examined earlier 87 "volumes" which were in fact of the thin dossiers containing reports on the breaches. Henceforth, the Yanukovich team is claiming now they have got not less than 800 volumes of the files to lodge to the court. The paradox is that this new law was already subjected to an examination at the Constitutional Court and it was stated that the Law met the Constitution, in its part where it concerned the respect of human rights. And court recommended to facilitate the voting of disabled persons and the CEC (Commission Electoral Cenral) implemented this recommendation. Thus, the appealing to the Supreme Court on these grounds would remain hopeless. As well, one must say, the most of these breaches had been examined by CEC and the Supreme Court, before the announcement of the final results of the vote. The judges had confirmed the validity of the decision to decline this complaint. And it is probable, this time the Court would examine not the dossier in full, but only the new facts. Thus, it takes not more than one or two days.

And even if the team of our new opposition makes too many efforts suggesting that the position of the court and the CEC is politically engaged, they will not be convincing too much. Because, one can say the Supreme Court and the CEC are scrupulously respecting all the procedures. And the question is: why then the team of Yanukovich wastes its time, what for to push the country towards the instability, if they have all prospects to lose? There could be cited several possible answers.

    Miming the rival
At the Yanukovich’s camp they were saying for many times to act miming the model of the team of Yuschenko plans after November 21. To see whether it will work or not it is enough to analyse the people’s reaction just after the announcement of the results of vote. Don’t you recall the tension on November 24, just after the president of the CEC at this time Serhiy Kivalov announced the win of Yanukovich? Million of citizens came to the streets all over the country to protest.

And on January 10, when Davydovich, new president of the CEC, announced the final results some dozens of the sympathizers to Yanukovich came to the CEC, but in one hour only, as by order they quitted the square. The appeals to make "revolted the east of the Ukraine as an enormous Maidan " resulted in revolt of three tents which were set in Donezk square, and in nearly of hundred people who came before the municipal administration at Luhansk. They were not so large in number as orange revolutionaries were.

However, these attempts to imitate the orange revolution can only incite to feel a kind of the compassion for the loser.

    To stay at political stage
That is mostly probable argumentation that could explain the Yanukovich’s actions. For him, the lawsuit at the court, especially public one, is the way to remain at the political stage longer, to figure on TV screens and in the newspapers. At present, everyone in Ukraine wishes to know who will be in new government and what they will do at first. So, for Yanukovich the only possibility to attract the attention to himself could be the lawsuit. It is the possibility not to fall at the political non-existence.
To impose himself as great figure of opposition
New image of opposition leader Yanukovich provoked many misunderstanding. However, one must recall that on the eve of parliamentary ballot it let him keep him playing. Otherwise, he has not many ways to go on be active political player. He is not deputy at the Parliament. Moscow lost its interest for Yanukovich, because Russians don’t like make policies with the phantoms. And after the oligarch of Donezk, Renate Ahmetov resolved to give up him, depriving of his strong support, Yanukovich is not able even to be leader of the Party of regions. Obvious, he is losing everywhere. And the prospects to become leader of the opposition is now too vague. That is why, Yanukovich needs to find arguments to be convincing for his potential voters that he is a real personality at the opposition camp.

    To protract procedure, without end....
Another way is to protract the whole thing, endlessly. Thus, forming of new government is reported, the very first steps of this government are delayed too. It is left too little time before the legislative ballot and each lost day will aggravate the situation and will incite people to lose its confidence towards its leaders.

These schemes are fruit of intellectuals of the Yanukovich’s team. But will it be implemented or not, that depends not only on the level of qualification of his aids, but also on new president too. If Yuschenko succeeds even a bit in raising the people living standards, all the efforts of Yanukovich will be brought to zero.
